Should something go wrong (the agent goes bust for instance) there is currently no law in place to protect that money & both landlord and tenant can be left out of pocket. Around 60% of agents are in the scheme voluntarily but the remainder of these offer no protection. All property agents in England must be become members of the Client Money Protection scheme (CMP) by April 2019. This is to encourage regulations that should improve people`s confidence in the private rental sector. Scotland & Wales have already imposed a compulsory membership of a client money protection scheme. The CMP is a compensation scheme which will look after landlords & tenants should the agent misappropriate their rent, deposit or any other client funds. It is now a legal requirement for letting agents in England to display if they are a member of a CMP scheme or not. Agents found to be handling client money without CMP will receive heavy fines or be shut down. Tenants deposits however, are protected under separate arrangements. Council officials say homes left vacant for long periods of time can cause problems for neighbours & areas. It can be hard to track down owners of properties meaning problems can linger while the council must pay repair costs that may never be recovered, bringing such properties back into use could provide much needed homes. Mayor Joe Anderson & his cabinet are set to approve plans to make it easier for the council to make Compulsory Purchase Orders (CPO`s) 鈥榯o acquire ownership of empty properties and vacant plots of land where these have been causing issues of blight or other problems in the neighbourhood`. A report to be considered by the council`s cabinet says, 鈥榯here are a large number of empty properties & small vacant sites in Liverpool which cause various issues for neighbouring residents including amenity problems, littering & dilapidation`. While long term vacant housing is increasing, homelessness is rising also & causing problems across the UK. Polly Neate, chef executive of charity Shelter said 鈥榠t`s a sad fact that homes are sitting empty while so many people & families are living without a roof over their heads. But, unfortunately, it`s not as easy as just giving these homes to the people who need them most. However, a regular complaint to the property ombudsman is dual fees being requested when a vendor has used 2 agents for marketing. The TPO code of practise is intended to ensure that no seller is put in a position where they are liable for 2 fees for the sale of a property. The TPO often sees situations where one agent will claim a fee based on being the initial agent & the second agent on having negotiated the sale but one or both is willing to negotiate a share of a single fee. Such instances tend to arise out of general confusion on behalf of the seller client, many of whom have no comprehension that such a situation could happen, not realising that an agent`s fee liability may extend after the end of the contract period which can be further exacerbated by the buyers, albeit innocent action. Agents needs to ensure that they fully explain to their seller clients the events that may lead to a potential of having to pay two fees & protect their client`s interest. Particularly where one agent is dis-instructed and another instructed. Agents should be clear & transparent in their details & any agreements should clearly set out that a seller may be liable to pay more than one fee if they have previously instructed another agent or they go on to instruct another agent during or after the agency period. Before letting your property to tenants, you should be aware of your rights as a landlord. It`s important to vet your tenants before moving them into your property. Any good letting agent will reference any potential tenants to make sure they have good credit & ensure that they`re unlikely to default on the rent. It`s recommended that your tenants also have a guarantor that you can go to in the unlikely event that they do fall behind with the rent. Should your rent fall into arrears there are a few steps you can take when it comes to trying to get it. 1. Keep a record of all payments. You should keep a record of all payments that have been made & what dates these were made on. 2. Write to your tenant. If after several days the rent hasn`t been paid you should write to tenant with a formal demand for the rent. This should be delivered by first class mail. 3. Write to the guarantor. If after 14 days you still haven`t received the outstanding rent, send the tenants guarantor a letter informing them that the tenant hasn`t paid the rent. This may push the tenant into action. 4. Take possession of your property. If the tenant has gone a whole month without paying rent & another rent is due, you can now consider your tenants to be 2 months in arrears. You then have the right, under The Housing Act 1988, to claim possession of your property. Serving a section 8 will inform your tenant that you intend to take them to court if they don`t pay within a further 14 days. 5. Court action. If your tenant doesn`t respond to your demands for rent, you are entitled to take legal action to seek possession of your property. You can also ask the court to make a judgement against your tenant for the arrears of rent & reasonable costs incurred. If you do act and do get a judgement against the tenant, you will have 6 years in which to enforce it. Hopefully you will never need to follow these steps but it`s always a good idea to be aware of your rights as a landlord. There hasn`t been a government campaign to raise awareness amongst agents & landlords despite the possibility of large penalties. Properties of 3 or more stories shared by 5 or more people (in 2 or more households) where the kitchen & bathroom are shared must now have a HMO license. On October 1st the 鈥榮toreys` criteria is going to be removed & any property of any height that meets the other criteria must be licensed. What agents may not know is that there is an important exemption; purpose-built flats within a block containing 3 or more self-contained flats are excluded from the requirement. Nothing from the housing ministry has explained this or other new HMO rules & yet the penalties are potentially severe enough to close a business down. A HMO that isn`t licensed when the law requires it could land the agent/landlord or both with a criminal prosecution and record, an unlimited fine & an order to pay court costs and a victim surcharge. The council could issue a civil penalty of up to 攏30,000 & a rent repayment order of up to 12 months rental income. The latest mortgage lending figures from banking trade body UK Finance shows there were 31,400 new first-time buyer mortgages completed during July 2018, compared with 5,500 for buy-to-let loans. The first-time buyer lending figures were up just 1% annually, while the number of buy-to-let mortgage approvals has fallen 14.1% over the same period. Home movers are also having a tough time with the number of mortgage approvals for those moving down 3.8% annually to 32,600. Re-mortgaging continues to dominate the market, up 23.1% since July 2017 to 46,900. Jackie Bennett, director of mortgages at UK Finance said; `The residential re-mortgaging market saw its strongest July in over a decade as home owners pre-empted the latest Bank of England rate rise by looking into attractive fixed-rate deals. There was also considerable growth in re-mortgaging in the buy-to-let sector, showing that while recent tax & regulatory changes are impacting on new purchases, many existing landlords remain in the market. The number of first-time buyers has returned to modest year-on-year growth. However, affordability remains a challenge for many perspective borrowers, underlining the importance of clarity over the future of schemes such as help to buy`. In September 2018, Bank of England governor Mark Carney warned that leaving the EU without a deal could send house prices falling by a third & UK growth would be 鈥榞uaranteed` to fall in the event of a no-deal Brexit. House prices did stall for a while following 2016`s referendum but this could also have been down to the usual pattern of prices fluctuating over spring & summer which we also saw in 2017. With Brexit looming closer, house prices suffered a larger post summer dip than usual in 2018, dropping from a peak of 攏232,797 in August to 攏230,630 in November. The latest ONS House Price Index shows that they crept up slightly in December, meaning that the current average UK house price is now 攏230,776. The rate of house price growth plummeted everywhere in the UK except for Scotland. It has continued to decrease in England ever since & Scotland also dipped down in December. However, there was significant growth in Wales & Northern Ireland.
